Refund Policy

  • Refund requests must be made within 30 days of purchase

  • Refunds will be processed using the original payment method
  • Processing may take 5-10 business days
  • Access to course materials will be revoked upon refund processing

Price Changes

Types of Damages

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Cost of procurement of substitute goods or services
  • Business interruption
  • Financial losses resulting from reliance on our educational content

Maximum Liability

Our total liability to you for all damages, losses, and causes of action shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 CAD, whichever is greater.

Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless JawFoattig and its directors, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Service
  • Your content submitted to the Service
  • Your violation of any third-party rights
  • Any harmful or illegal activities conducted through your account

11. Termination

Termination by You

You may terminate your account at any time by:

  • Logging into your account and following the account closure process
  • Contacting our customer support team
  • Ceasing to use the Service

Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice, if:

  • You breach these Terms of Service
  • You engage in fraudulent or illegal activities

  • We decide to discontinue the Service

Effect of Termination

Upon termination:

  • Your right to use the Service will cease immediately
  • Access to course materials and account data will be revoked
  • Provisions of these Terms that should survive will remain in effect
  • Outstanding fees and obligations will remain due

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Canada and the Province of Ontario, without regard to conflict of law principles.

Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Toronto, Ontario, Canada, and you hereby irrevocably consent to the personal jurisdiction and venue therein.

14. Dispute Resolution

Informal Resolution

Before filing a formal dispute, we encourage you to contact us directly to resolve any issues. Most concerns can be resolved quickly through direct communication.

Formal Disputes

If informal resolution is not possible, disputes will be resolved through:

  • Binding arbitration in accordance with the rules of the ADR Institute of Canada
  • The arbitration will take place in Toronto, Ontario
  • The arbitration will be conducted in English
  • Each party will bear their own costs unless otherwise awarded

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will continue to be valid and enforceable. The invalid provision will be deemed modified to the extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and JawFoattig regarding the use of our Service and supersede all prior and contemporaneous written or oral agreements.
